Privacy policy and data protection

This policy (hereinafter the “Policy”) sets out positive.ai’s commitments regarding the use and protection of the personal data of Internet users (hereinafter the “Users”) visiting the site accessible from the following URL: https://www.positive.ai (hereinafter the “Site”).

In accordance with Article 12 of the Universal Declaration of Human Rights and Article 14 of the International Covenant on Civil and Political Rights, and within the framework of United Nations General Assembly Resolution 68/167 of June 30, 2014 on the right to privacy in the digital age, Positive.ai is committed to the universal protection of individuals against any interference with their privacy and guarantees all individuals using the https://www.positive.ai website the protection of their personal data.

This policy (hereinafter the “Policy”) sets out positive.ai’s commitments regarding the use and protection of the personal data of Internet users (hereinafter the “Users”) visiting the site accessible from the following URL: https://www.positive.ai (hereinafter the “Site”).

This Policy may be modified or supplemented at any time by Positive.ai, in particular in order to comply with any legal or technological developments in the field. In such a case, the date of the update will be clearly identified at the top of the Policy. Such changes are binding on the User as soon as they are posted online. It is therefore advisable for the User to consult the Policy regularly in order to take note of any modifications.

I. Personal information

In general, Users may visit the Site without providing any personal information. In any case, the User is under no obligation to transmit any information to Positive.ai.

Nevertheless, Positive.ai may in certain cases ask the User to provide certain information (hereinafter referred to as “Personal Information”) so that the User can benefit from certain requested information or services. By providing this data, the User expressly agrees to its processing by Positive.ai, for the purposes set out in point 3 below.

In accordance with the general principles of international law concerning respect for the right to privacy of individuals and, more specifically, the protection of personal data, Positive.ai informs Users of the following:

1. Identity of the data controller

The data controller is Positive.ai, an association under the French law of 1901, created in June 2022, under the number W751265848, having its registered office at 128 rue la Boetie 75008 Paris.

2. What data is collected?

Positive.ai may collect the following personal data.

  • For contact requests: identification data (surname, first name, company), email;

  • To send personalized information: e-mail address, surname, first name.

  • Browsing data (logs, browser type, IP address, etc.)

  • Positive.ai may also collect certain data indirectly (see paragraph 3 below on cookies).

3. Data processing purposes

Positive.ai may process Users’ Personal Information.

4. Recipients

Positive.ai is the sole recipient of personal information collected from Users. This information, whether in individual or aggregated form, is never transmitted to a third party, notwithstanding the subcontractors that Positive.ai may call upon, subject to their commitment to respect the Policy. Neither Positive.ai nor any of its subcontractors and experts market the personal data of visitors and Users of its site.

5. Retention period

The Personal Information collected from Users is kept by Positive.ai only for the time corresponding to the purpose of the collection, as indicated in point 3 above, which in any event shall not exceed 1 year.

6. Data protection rights

Users have the following rights concerning their Personal Information, which may be exercised by writing to Positive.ai at the postal address mentioned in point 1.

  • Right to data portability
  • Right to erasure
  • Right to limitation

7. Response times

Positive.ai undertakes to respond to any User’s request to exercise a right or to any other request for additional information within a reasonable period of time, which may not exceed 1 month from the date of receipt of the request.

II. Policy on cookies and other tracers

When connecting to the site for the first time, the User is warned by a banner that information relating to his/her browsing may be recorded in files known as “cookies”. The purpose of Positive.ai’s cookie use policy is to set out the provisions implemented for browsing on the site, and in particular to inform Users about all the cookies present on the site, their purpose (part I.) and the steps to follow to set their parameters (part II.).

1. General information about cookies on the Site

Positive.ai, as publisher of the site, may install a cookie on the hard disk of the User’s terminal (computer, tablet, cell phone, etc.) in order to guarantee fluid and optimal browsing on the site.

Cookies” are small text files of limited size which enable the User’s computer, tablet or cell phone to be recognized, in order to personalize the services offered.

The information collected via cookies does not in any way identify a User by name. It is used exclusively for Positive.ai’s internal purposes, in order to improve the site’s interactivity and performance, and to send Users content tailored to their centers of interest, based on their previous visits. None of this information is communicated to third parties except when Positive.ai has obtained the prior consent of the User concerned, or when disclosure of this information is required by law, by order of a court or any administrative or judicial authority empowered to deal with it, and Positive.ai accepts the jurisdiction thereof.

2. Setting your cookie preferences

The User may accept or refuse the deposit of cookies at any time

When the User first connects to the site, a banner briefly presenting information on the deposit of cookies and similar technologies appears at the bottom of the screen.

Cookies exempt from consent

Certain cookies do not require the prior consent of the User insofar as they are strictly necessary for the operation of the site or are used exclusively to enable or facilitate electronic communication. These include session ID cookies, authentication cookies, load balancing session cookies and interface personalization cookies. These cookies are fully subject to the Policy insofar as they are issued and managed by Positive.ai.

Cookies requiring the User’s prior consent

Didomi: Statistical purposes.

The User’s consent is required in the case of cookies issued by third parties and qualified as “persistent” in that they remain on the User’s terminal until they are deleted or expire.

As such cookies are issued by third parties, their use and storage are subject to their own privacy policies, the link to which is provided below. This family of cookies includes audience measurement cookies (notably Didomi) and advertising cookies (which Positive.ai does not use).

Audience measurement cookies are used to compile statistics on visitor numbers and the use of various elements of the site (such as content/pages visited). This data is used to improve site ergonomics.

Most Internet browsers are configured by default to allow the deposit of cookies. All browsers offer the option of modifying these standard settings so that all cookies are systematically rejected, or so that only some cookies are accepted or rejected, depending on the sender.

CAUTION: Positive.ai draws the attention of Users to the fact that refusing to accept cookies on a terminal may nevertheless alter the User’s experience and access to certain services or features of the site. Where applicable, Positive.ai declines all responsibility for the consequences of any deterioration in browsing conditions resulting from the User’s choice to refuse, delete or block the cookies required to operate the site. Such consequences shall not constitute damage entitling the User to any compensation whatsoever.

The User’s browser can also be used to delete existing cookies from the terminal, or to indicate when new cookies are likely to be placed on the terminal. These settings have no effect on browsing, but do remove all the benefits of cookies.
